Welcome to Nuwi Art. These Policies & Terms apply to purchases, digital products, original artworks, prints, private commissions and your use of the Nuwi Art website.
By using this website or placing an order, you acknowledge that you have read and understood these policies and agree to be bound by them.
1. About Nuwi Art
Nuwi Art is an art business based in Sri Lanka offering original artworks, art prints, digital downloads and private commissioned artwork.
Throughout these policies, “Nuwi Art”, “we”, “us” and “our” refer to Nuwi Art.
2. Orders & Payments
All prices displayed on the website are stated in the currency indicated at the time of purchase.
Orders can be paid securely using PayPal and card payments processed through PayPal.
When you place an order, you are making an offer to purchase the selected product. An order is considered accepted once payment has been successfully received and the order has been confirmed by Nuwi Art.
We reserve the right to cancel or decline an order where there is a genuine issue involving product availability, pricing, payment, suspected fraud, incorrect information or circumstances beyond our reasonable control. If we cancel an order after payment has been received, the applicable payment will be refunded.
Please ensure that your billing, shipping and contact information is accurate before completing your purchase.
3. Original Artwork
Each original artwork is an individual work created by the artist. Minor variations in colour, texture, surface appearance and presentation may occur between the artwork displayed on screen and the physical artwork received.
Colours may also appear differently depending on your monitor, screen settings and device.
Unless otherwise stated, an original artwork is sold as the physical original only and does not transfer copyright or reproduction rights to the purchaser.
The purchase of an original artwork does not grant permission to reproduce, copy, scan, commercially exploit or create derivative works from it.
4. Art Prints
Prints are reproductions of original artwork and are produced according to the specifications stated on the relevant product page.
Slight variations in colour and appearance may occur due to differences between digital displays and physical printing processes.
Prints are intended for personal use unless otherwise stated.
5. Digital Downloads
Digital products are delivered electronically and do not include a physical product.
Once payment has been successfully completed, the applicable download instructions or download access will be provided through the website or by email.
Because digital products can be accessed immediately after purchase, digital downloads are generally non-refundable once the file or download access has been provided, except where a refund is required under applicable law or where the purchased file is materially defective and cannot reasonably be corrected.
Digital files may not be resold, redistributed, uploaded to file-sharing platforms, sublicensed or commercially exploited without written permission from Nuwi Art.
6. Shipping & Delivery
Nuwi Art ships physical artwork and prints internationally.
Shipping costs, where applicable, are displayed during the checkout process or otherwise communicated before the order is confirmed.
Delivery times vary depending on the destination, shipping method, customs procedures and the nature of the artwork.
Estimated delivery periods are estimates only and are not guaranteed delivery dates.
Once an order has been handed over to the selected shipping or courier provider, delays caused by the carrier, customs authorities, weather, public events, incorrect delivery information or circumstances beyond our reasonable control are outside Nuwi Art’s direct control.
International customers are responsible for ensuring that the destination country permits the import of the purchased item.
7. Customs, Duties & Import Taxes
International orders may be subject to customs duties, import taxes, VAT, brokerage charges or other fees imposed by the destination country.
Such charges are determined by the destination country’s authorities and are generally the responsibility of the purchaser unless otherwise stated at checkout.
Nuwi Art does not control customs decisions, import charges or clearance times.
Customers are responsible for providing accurate information required for international delivery and customs clearance.
8. Returns & Refunds
All sales are considered final.
Nuwi Art does not generally accept returns or exchanges for original artworks, prints or other physical products simply because a customer changes their mind, orders the wrong item, or no longer wishes to keep the purchase.
Digital downloads are also non-refundable once access to the purchased file has been provided, except where required by applicable law or where the file is materially defective and cannot reasonably be corrected.
We carefully package physical artwork before dispatch. If an item arrives damaged, incorrect or materially different from the item ordered, please contact us as soon as possible after delivery with your order details and clear photographs of the packaging and artwork.
Where a remedy is required under applicable law, Nuwi Art will provide the appropriate remedy.
Refunds, where approved, will normally be made through the original payment method.
9. Damaged or Incorrect Orders
If your artwork or print arrives damaged or you receive an incorrect item, please contact Nuwi Art promptly at:

Photographs of the package and shipping label
Photographs showing the damage or incorrect item
A brief description of the issue
Do not discard the original packaging until the matter has been reviewed, as photographs or inspection of the packaging may be required when making a claim with the shipping provider.
10. Private Commissions
Nuwi Art accepts a limited number of private commissions based on the artist’s availability, artistic direction and suitability of the requested subject.
The minimum commission value is USD $250, with a minimum artwork size of 16 × 20 inches.
Submitting a commission inquiry does not mean that the commission has been accepted.
Each inquiry is individually reviewed before acceptance. Nuwi Art reserves the right to decline a commission where the requested subject, style, reference material, timeline or artistic direction is not suitable.
The commission process generally consists of:
01 The Beginning
Initial inquiry and review.
02 The Vision
Consultation and discussion of the subject, composition and artistic direction.
03 The Creation
The artwork is created according to the agreed direction.
04 The Journey Home
The completed artwork is prepared and delivered to the collector.
Specific payment schedules, deposits, timelines, shipping arrangements and other commission conditions will be communicated and agreed upon before work begins.
11. Commission Deposits & Cancellations
A commission is not considered confirmed until the required payment or deposit has been received and the commission has been formally accepted.
Because commissioned artwork involves dedicated creative time and resources, deposits may be non-refundable once work has commenced, subject to applicable law and the specific terms agreed for the commission.
If a commission must be cancelled due to circumstances on the part of Nuwi Art, any refund due will be communicated and processed according to the agreed commission terms and applicable law.
The artist retains creative discretion over the final artwork, including composition, interpretation, colour, cropping, detail and other artistic decisions.
12. Reference Images & Copyright
Collectors providing reference photographs for commissioned artwork must have the legal right to use those photographs for the commission.
If a reference photograph was taken by a professional photographer or another copyright owner, the collector must obtain appropriate permission before the image is used as a reference for the commissioned artwork.
By submitting reference material, you confirm that you have the necessary rights or permissions to provide that material for this purpose.
Nuwi Art does not knowingly reproduce copyrighted photographs or artwork without appropriate authorization.
Nuwi Art may decline a commission where sufficient rights or permissions for the supplied reference material cannot be established.
13. Artistic Interpretation
A commission is an original work of art and is not intended to be an exact mechanical reproduction of a reference photograph.
The artist retains artistic discretion over interpretation, composition, technique, colour, detail, cropping and other creative elements.
Requests that conflict with the artist’s established style or artistic direction may be declined.
Nuwi Art does not accept requests to reproduce another artist’s work or copyrighted artwork without appropriate authorization.
14. Intellectual Property & Copyright
All artwork, photographs, illustrations, written content, logos, graphics, website designs and other original materials appearing on the Nuwi Art website are protected by applicable intellectual property and copyright laws unless otherwise stated.
Copyright in artwork remains with the artist unless expressly transferred in writing.
Purchasing an original artwork, print or digital product does not transfer copyright ownership.
You may not reproduce, copy, modify, distribute, sell, license or commercially exploit Nuwi Art’s artwork or digital content without prior written permission.
Personal, non-commercial use of purchased digital products is permitted only where expressly stated on the relevant product page.
15. Artist’s Right to Display Completed Commissions
Unless otherwise agreed in writing, Nuwi Art may photograph or reproduce images of completed commissioned artwork for portfolio purposes, including on the Nuwi Art website, social media, exhibitions, promotional materials and other marketing channels.
If a collector requires a completed commission to remain private and not be publicly displayed, this must be discussed and agreed upon before the commission is accepted.
16. Website Content
We make reasonable efforts to ensure that the information presented on the Nuwi Art website is accurate and current.
However, product availability, prices, descriptions, images and other information may occasionally contain errors or require updates.
Nuwi Art reserves the right to correct errors, update information and modify or discontinue products without prior notice.
Website content is provided for general information and should not be treated as a guarantee of availability or suitability for a particular purpose.
17. Third-Party Services & Links
The Nuwi Art website may use third-party services, including payment providers, hosting providers, shipping providers, analytics services and other external platforms.
Payments are processed through PayPal and its applicable payment infrastructure. Nuwi Art does not directly receive or store your complete payment-card details when payment is processed through PayPal.
The website may also contain links to third-party websites. Nuwi Art is not responsible for the content, privacy practices, security or availability of third-party websites.
18. Privacy Policy
Nuwi Art respects your privacy and handles personal information responsibly.
When you browse the website, place an order, submit a commission inquiry or contact us, we may collect information such as your name, email address, telephone number, billing information, shipping address, order information and other information you voluntarily provide.
We may use this information to:
Process and fulfil orders
Arrange delivery
Process payments
Respond to inquiries
Manage private commissions
Provide customer support
Send transaction-related communications

Prevent fraud and unauthorized transactions

Payment information is processed through the applicable payment provider. We do not intentionally store complete payment-card details on our own systems.

We do not sell your personal information as a product.
We take reasonable measures to protect personal information against unauthorized access, alteration, disclosure or loss. However, no internet transmission or electronic storage system can be guaranteed to be completely secure.

20. Fraud & Unauthorized Transactions
Nuwi Art reserves the right to delay, decline or cancel transactions where there are reasonable concerns regarding fraud, unauthorized payment activity, inaccurate customer information or other suspicious activity.
Where an order is cancelled after payment has been received, any applicable refund will be processed through the original payment method, subject to applicable law and the circumstances of the transaction.
21. Limitation of Liability
To the extent permitted by applicable law, Nuwi Art will not be responsible for losses arising from circumstances beyond our reasonable control, including delays caused by shipping providers, customs authorities, natural events, technical failures, internet interruptions, strikes, public events or other unforeseen circumstances.
Nothing in these terms is intended to exclude or limit any liability or consumer right that cannot lawfully be excluded or limited under applicable law.
22. Events Beyond Our Control
Nuwi Art will not be considered in breach of these terms where performance is prevented or materially delayed by circumstances beyond our reasonable control.
Such circumstances may include natural disasters, severe weather, war, civil unrest, government restrictions, strikes, transportation disruption, customs delays, internet or infrastructure failures, illness or other circumstances that could not reasonably have been prevented.
Where such circumstances affect an order or commission, we will make reasonable efforts to communicate the situation and provide an appropriate update.
23. Disputes & Governing Law
These Policies & Terms are governed by the laws applicable in Sri Lanka, subject to any mandatory consumer-protection rights that may apply to the customer.
If you have a concern regarding an order, we encourage you to contact Nuwi Art first so that we can attempt to resolve the matter directly.
Nothing in these terms prevents a consumer from exercising any rights or remedies available under applicable law.
24. Changes to These Policies
Nuwi Art may update these Policies & Terms from time to time to reflect changes to our services, website, business practices or applicable legal requirements.
The updated version will be published on this page with a revised “Last Updated” date.
Your continued use of the website after an update constitutes acceptance of the revised terms to the extent permitted by applicable law.
